Attorney and city school board member Van White says he'll challenge in court county Board of Elections rulings that have disqualified him from running a primary against Democratic State Assembly member David Gantt. The BOE ruled today.
White filed petitions with the Board of Elections containing 1,132 signatures. But the board disqualified all but 488 of them, leaving White short of the 500 signatures he needs to get on the ballot.
Of those signatures, 346 were disqualified because the people who signed them were not registered as Democrats at the addresses they gave. White says that's a bogus reason to disqualify those signatures, and that state law requires only the address a person lives at, not the address they're registered at.
Because of the transient nature of much of the city's population, "it contradicts the reality of urban life," White says.
White says the BOE also ruled against him on residency. It said he's registered to vote in a different Assembly district. But White says he owns property in the 133rd, that he's stayed there on many occasions, and that he has connections to the district.
He expects to file his court challenge by tomorrow, he says.

~In order to be on the primary ballot, Van White needs to retrieve "only" 12 signatures out of the 644 rejected by the Board of Elections, i.e., 2%. He targets the 346 signatures of Democrats not registered currently at the Board of Electio...ns at the address they gave on the petition, in order hopefully to obtain those 12 newly-valid signatures.
Without being certain of which specific signatures the Board of Elections had targeted, as it rules only in general categories, he now has to visit quite a few homes to see whose signature might be valid, hoping to find at least 12 at home to verify this. Those "lucky" voters might well have to appear subsequently (during working hours) in court to testify as to their actual residence. Even so, election regulations may not allow such signatures.
Sound simple?
From receiving the Board of Elections letter on Saturday, Van White would have only until today (Wednesday) to visit a sufficient number of homes, hoping to find valid some voter addresses that had been disallowed, prepare affidavits on this, prepare a memorandum of law on the legal issue, prepare a Petition and a proposed Order to Show Cause, obtain an Index Number, request Judicial Intervention, find a Supreme Court Justice to sign the Order to Show Cause, file same, AND then serve all the papers --- ALL within 3 business days, i.e., by midnight today.
Can anyone doubt but that election procedures are statutorily designed to inhibit and discourage challengers?
